1. Legal Information & Acceptance
These Terms & Conditions ("Agreement") govern your use of the SafiConfirm platform ("Platform") operated by Qilze Technologies ("Company", "we", "us", "our"). By accessing, using, or registering on the Platform, you agree to be bound by these terms. If you do not agree with any part of these terms, you may not use the Platform.
2. Accessibility
The Platform is accessible to individuals and businesses seeking to reduce cash-on-delivery (COD) failure rates through AI-powered order confirmation services. The Platform is not intended for minors under 18 years of age. If you are under 18, you must obtain parental or guardian consent before using the Platform.
3. Definitions
"User" – Any individual or business entity registering and using the Platform.
"Content" – All information, data, scripts, and materials uploaded or created by Users.
"Service" – The AI-powered order confirmation platform and related features.
"Account" – The registered profile created by the User on the Platform.
"Intellectual Property" – Patents, trademarks, copyrights, and proprietary knowledge.
4. Registration & Account Requirements
4.1 Registration Process: To use the Platform, you must create an Account by providing accurate, complete, and current information including your full name, email address, business details, and password.
4.2 Account Responsibility: You are responsible for maintaining the confidentiality of your login credentials and are solely responsible for all activities that occur under your Account.
4.3 Accurate Information: You agree to provide accurate and truthful information during registration and to update it whenever changes occur. False or misleading information may result in account suspension or termination.
4.4 Single Account: Each User may maintain only one primary Account. Multiple accounts are prohibited and may result in termination.
5. Orders, Requests & Service Processing
5.1 Order Entry: Users can submit orders manually or via bulk upload. Each order must include the Customer Name, Contact Number, and Order Details. Address information is optional but recommended for accuracy.
5.2 Order Validation: The Platform will validate submitted orders for completeness and accuracy. Invalid orders will be flagged for review before processing.
5.3 Processing Timeline: Confirmed orders will be processed according to the scheduled batch time. Processing times may vary based on service tier and system load.
5.4 Order Status: Users can track order status in real-time through the Dashboard. Status updates include: Pending, Processing, Completed, Failed, and Cancelled.
6. Services & Pricing
6.1 Service Description: SafiConfirm provides an AI-powered platform for automated order confirmation via voice or messaging channels, designed to reduce COD failure rates.
6.2 Pricing Plans: Pricing is based on service tier selection (Starter, Professional, Enterprise). Each tier includes a specific number of monthly credits. Current pricing is available on the Pricing page.
6.3 Service Limitations: We reserve the right to modify, suspend, or discontinue any service with reasonable notice (minimum 30 days).
6.4 Uptime: While we strive for 99.5% service availability, we do not guarantee uninterrupted access. Scheduled maintenance may occur with prior notice.
7. Payment Terms & Processing
7.1 Payment Method: Users agree to provide valid payment information for subscription renewals and additional services.
7.2 Billing Cycle: Subscriptions are billed monthly on the same date each month, unless modified or cancelled.
7.3 Refund Policy: Refunds are available only for unused credits and must be requested within 30 days of purchase. Processed services are non-refundable.
7.4 Late Payment: Accounts with outstanding payments may have service access suspended until payment is received.
8. Service Delivery & Acknowledgment
8.1 Service Acknowledgment: By using SafiConfirm, you acknowledge that the Platform uses AI technology which may occasionally produce errors or unexpected results.
8.2 User Responsibility: You are responsible for reviewing AI-generated content and approving confirmation scripts before deployment to customers.
8.3 Content Ownership: You retain ownership of all customer data and order information provided. We retain the right to process and use this data solely for service delivery.
8.4 Compliance: You agree to comply with all applicable laws and regulations, including data protection and consumer protection laws specific to Morocco and your jurisdiction.
9. Limitation of Liability
9.1 No Warranties: The Platform is provided "AS IS" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
9.2 Limitation: To the maximum extent permitted by law, SafiConfirm shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.
9.3 Maximum Liability: Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.
9.4 User Actions: We are not responsible for your use of AI-generated content or decisions made based on Platform data.
10. Complaints & Dispute Resolution
10.1 Complaint Process: Any complaints regarding the Platform should be submitted in writing to contact@qilze.com with detailed description and supporting evidence.
10.2 Resolution Timeline: We will acknowledge complaints within 48 hours and provide a resolution within 30 days.
10.3 Escalation: If you are unsatisfied with the resolution, you may escalate your complaint to our management team.
10.4 Consumer Rights: This complaint process does not limit your consumer protection rights under Moroccan law.
11. Intellectual Property Rights
11.1 Platform Ownership: All content, design, code, algorithms, and functionality of the SafiConfirm Platform are the exclusive property of Qilze Technologies and protected by international copyright laws.
11.2 User License: We grant you a non-exclusive, non-transferable, revocable license to use the Platform solely for lawful business purposes.
11.3 Restrictions: You may not reverse-engineer, decompile, modify, or create derivative works based on the Platform. You may not attempt to bypass security measures or access unauthorized portions of the Platform.
11.4 Third-Party Content: All third-party integrations and partners retain their respective intellectual property rights.
12. Prohibited Activities
You agree not to engage in any of the following activities:
- Submitting false, misleading, or illegal orders
- Using the Platform for harassment, fraud, or illegal purposes
- Attempting to access other users' accounts or data
- Uploading malware, viruses, or malicious code
- Violating privacy or data protection regulations
- Engaging in any form of spam or unsolicited communications
- Reselling or redistributing the Platform without authorization
13. Governing Law & Jurisdiction
13.1 Governing Law: These Terms & Conditions are governed by the laws of Morocco, without regard to its conflict-of-law principles.
13.2 Jurisdiction: Both parties irrevocably submit to the exclusive jurisdiction of the courts of Morocco for any dispute resolution.
13.3 Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.
14. Dispute Resolution Process
14.1 Negotiation: In case of disputes, both parties agree to first attempt good faith negotiation for 30 days.
14.2 Mediation: If negotiation fails, the parties agree to pursue mediation before initiating legal proceedings.
14.3 Legal Action: Only after exhausting negotiation and mediation may either party pursue legal action in the courts of Morocco.
15. Termination
15.1 Voluntary Termination: You may terminate your Account at any time by submitting a request to contact@qilze.com
15.2 Suspension/Termination by Company: We reserve the right to suspend or terminate your Account for violation of these Terms, non-payment, or illegal activity.
15.3 Data Retention: Upon termination, your personal data will be processed according to our Privacy Policy.
16. Changes to Terms
We reserve the right to modify these Terms & Conditions at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Platform following changes constitutes your acceptance of the new terms.
